Nothing in zoning regulations requires owner occupancy for approval of a two-family dwelling. The proposed two-family dwelling, including the attached garage and apartment, will not adversely affect the character of the area. If the apartment were reduced in size to 30% of the floor space of the existing living area of the house, and if the other criteria for an accessory apartment are met, the addition may also qualify independently for approval as an accessory apartment under 24 V.S.A. ยง 4406(4)(D).
